Terms of Service

These Terms of Service (“Terms”) govern the relationship between you (“User” or “You”) and Vu Le (“Us” or “We”), regarding your use of our games, websites, and related services (the “Service”). By using the Service, you agree to these Terms, as well as our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please discontinue use of the Service.

LICENSE

1.1 Grant of Limited License to Use the Service
We grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Service for non-commercial, personal entertainment purposes, subject to your compliance with these Terms.

1.2 Restrictions on Use
You agree not to:

  • Use the Service if you are under 13 years old. Users aged 13 to 17 must have parental or guardian consent.
  • Attempt to gain unauthorized access to the Service, modify, or disrupt the Service or any associated data.
  • Use cheats, bots, hacks, or unauthorized third-party software to interfere with the Service.
  • Share, sell, or transfer your game progress, accounts, or virtual items to other users or third parties.
  • Post offensive, abusive, infringing, or objectionable content within the Service.

Failure to comply with these restrictions may result in the termination of your access to the Service.

ACCOUNTS AND LOGIN INFORMATION

2.1 Guest Accounts
When you access the Service without linking an email, a default guest account is created using a unique identifier derived from your device hardware ID. The guest account is tied exclusively to your device. Deleting the game or resetting the device may result in the loss of progress.

2.2 Linking an Email Account
By linking an email account, your progress can be saved and accessed across multiple devices. You agree to provide accurate information and maintain the security of your login credentials.

2.3 Account Security
You are responsible for all activity conducted under your guest or linked account. Notify us immediately at [email protected] if you suspect unauthorized access or security issues.

2.4 Account Deletion
You may delete your account at any time through the game settings or by contacting us. However, you acknowledge and agree that:

  • Deleting your account is permanent and cannot be reversed.
  • Once deleted, all associated progress, virtual items, and in-game currency will be lost and cannot be restored.
  • We are not responsible for any loss, damages, or consequences resulting from the deletion of your account, whether intentional or accidental.
  • For in-app purchases made through Apple or Android platforms, we are not responsible for reimbursing or refunding these purchases if you delete your account.

2.5 Rule Enforcement
We reserve the right to ban or suspend any account, including linked or guest accounts, if you violate these Terms or engage in behavior that disrupts the Service or its community.

OWNERSHIP

3.1 Service Content
All intellectual property rights in the Service, including games, designs, graphics, and software, are owned by or licensed to Vu Le. You do not own any content within the Service, including virtual items or in-game currency.

3.2 Virtual Items
In-game virtual items or currency are non-refundable, non-transferable, and have no real-world monetary value. We reserve the right to manage, modify, or remove such items at our sole discretion.

USER-GENERATED CONTENT

You are solely responsible for content you post or share within the Service, including chat messages or uploaded files. By posting content, you grant Vu Le a perpetual, royalty-free, worldwide license to use, modify, and display your content as necessary to provide the Service.

Content violating these Terms (e.g., offensive, infringing, or illegal content) may be removed, and the responsible account may be banned without prior notice.

DATA COLLECTION AND PRIVACY

By using the Service, you acknowledge and agree to our data collection practices as outlined in the Privacy Policy.

5.1 Guest Account Creation
We use your device hardware ID to create a guest account for saving progress locally. No additional personal information is collected for guest accounts.

5.2 Data Collected for Linked Accounts
If you link your email, we collect your email address to save progress across devices. Credentials are securely hashed using SHA-256.

TERMINATION OF SERVICE

We reserve the right to terminate or suspend your access to the Service at any time for any reason, including but not limited to violations of these Terms. Upon termination, your progress, virtual items, or currency may no longer be accessible.

You may also terminate your use of the Service by deleting your account. However, as outlined in Section 2.4, we are not responsible for any loss resulting from account deletion, including the loss of in-app purchases made through Apple or Android platforms.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

7.1 No Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee uninterrupted access or error-free functionality.

7.2 Limitation of Liability
To the fullest extent permitted by law, Vu Le Studios will not be liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the Service. Our total liability shall not exceed the amount you have paid to us in the six (6) months prior to the claim.

7.3 Account Tampering and Unauthorized Access
We are not responsible for any loss, damage, or unauthorized changes to your account, including but not limited to tampering, hacking, or any activities by third parties or other users that violate these Terms. You acknowledge that maintaining the security of your account and adhering to these Terms is your responsibility.

DISPUTE RESOLUTION

8.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of laws principles.

8.2 Dispute Resolution
You agree to attempt resolution by contacting us at [email protected] before pursuing legal remedies. Any unresolved disputes will be subject to binding arbitration unless prohibited by local law.

UPDATES TO THE SERVICE

We may modify or update the Service or these Terms at any time without prior notice. Continued use of the Service after updates signifies acceptance of the changes.

GENERAL PROVISIONS

10.1 Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.2 Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and Vu Le Studios concerning the Service.

10.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
